Covenants Not To Compete

Many areas of business use employee agreements with covenants not to compete. Doctors, engineers, and mortgage brokers work under non-compete agreements. Even hairdressers are sometimes required to sign non-compete clauses.

Many employees do not give the matter much thought. But non-compete agreements are important provisions for businesses who want to retain their share of a competitive market. Conversely, some employment contracts present unfair obstacles to professionals and small business owners seeking their rightful niche in the marketplace. Non-compete disputes result from two common scenarios:

  • Employment contracts: Non-compete clauses in many employment contracts prohibit a former employee from working in that field inside a specified radius and time frame. These covenants can be crucial for a former employer. But in many cases they do not stand up in court.   • Sale of a business: The sale of a business often incorporates a non-compete agreement. In these cases, the former business owner promises not to directly compete with the new business owner. As with employment contracts, a prohibited physical radius and time frame is frequently applied.
