Energy & Utility Law
Indiana Energy and Utility Law Lawyers
Lewis & Kappes represents energy consumers and utility ratepayers in negotiations and court actions as well as regulatory proceedings. Changes in energy law are sweeping the state and nation, as competitive forces are introduced to markets traditionally dominated by regulation. With those changes, conventional utility law is being integrated more and more with principles of general commercial law, in areas such as antitrust and trade regulation, products liability and contract law.
Lewis & Kappes has long been active in utility regulation as well as commercial and business litigation and business law , and offers the diversity of experience and innovative approaches that the developing energy marketplace demands. Our clients include large volume energy consumers such as industrial facilities and educational and medical institutions, as well as municipalities and small businesses. We are active in a variety of utility and regulated industry areas, including:
- Gas and electric
- Telecommunications
- Water and sewer
- Riverboats and charitable gaming institutions
- Motor carriers, truck drivers and attendant trucking regulations
Lewis & Kappes has handled a variety of significant cases involving energy disputes and utility regulation. Two of our attorneys were honored by the Indiana Trial Lawyers Association with the Trial Lawyer of the Year Award for their work on an electric utility case that resulted in a $150 million refund to consumers.
We successfully represented a non-profit electricity cooperative in a court action seeking to terminate a long-term exclusive energy contract and gain access to the competitive market. Our attorneys also represented a chain of retail stores in both court and regulatory proceedings challenging the practice of mall owners that purchased electricity from an electric company at discount rates and then charged tenants at higher rates.
Our involvement with INDIEC has given us the opportunity to keep large volume consumers informed and actively involved in current issues facing the energy industry, including a prominent role in the drafting and submission of electric restructuring legislation before the Indiana General Assembly.
In short, the energy litigation and regulatory compliance lawyers of Lewis & Kappes have the experience to assist with any energy and utility issue. The firm is large enough to handle large-scale litigation with a gas company but small enough to give our clients the attention and personal service they need.
